Auction Terms - Online Auction - 2 to 6 September 2022

  1. Kattenheye.Horse Auction is organized by Tony Raman with registered office at Lagen Heirweg 9, 9270 Laarne - Belgium.
  2. Participation in this auction implies the express and unreserved knowledge and acceptance of these auction conditions.
  3. Tony Raman sells horses (embryos, foals, brood mares, ...) and semen through its website on behalf of and for their own account. The buyer must register via the website www.kattenheye.horse before he can participate in the Kattenheye.Horse Auction.
  4. The horses are auctioned in the condition they are in at the time of the auction. The veterinary reports can be viewed online.
  5. The sale is effected according to Belgian law by means of auction and allocation to the highest bidder after payment of the settlement amount, whether or not to be increased with VAT. The auction is supervised by an auctioneer to be appointed by Kattenheye, who draws up an official report of the allocation.
  6. Bids and payments are made in EURO. The auction proceeds according to the following bidding steps: From 500 euro - 20.000 euro by €500,- From 20.000 - 50.000 euro by €1000,- From 50.000 euro - 100.000 euro by €2000,-
  7. An indicative closing time for the auction per lot is indicated on the website. However, if a bid is made on a lot in the last 5 minutes before closing, the auction concerning that lot will automatically be extended by 5 minutes. The extended time will become the new indicative closing time.
  8. The buyer does not pay any commission on top of the allotment price.
  9. All lots are allocated to the highest bidder at the end of the auction. The settlement is calculated with regard to the buyer as follows: the allocation price = net price, plus any applicable VAT, is the settlement amount. By submitting a bid, the bidder undertakes to pay the settlement amount, unless a higher bid is subsequently placed.
  10. The settlement amount is immediately due upon allocation.
  11. The foal can be picked up in Laarne at the expense of the buyer, at a time indicated by Kattenheye (not earlier than the age of 4.5 months). The collection will only take place once the settlement amount as defined in Article 9 has been credited to Kattenheye's account. The foals can be insured at the expense of the buyer (possibly through Catherine De Buyl Assurance). Foals that remain in rearing here are compulsorily insured via the insurance offered, at the expense of the buyer. The liability and risk with regard to the auctioned foals transfers from the seller to the buyer, immediately after the foal has been sold.
  12. Embryos or broodmares can be collected in Laarne at the expense of the buyer, at a time specified by Kattenheye. The collection will only take place once the settlement amount as defined in Article 9 has been credited to Kattenheye's account. The embryos / broodmares can be insured at the expense of the buyer from the period after the auction to 120 days after birth. The liability and risk with regard to the auctioned lots passes from the seller to the buyer, immediately after the broodmare/surrogate mother has been sold.
  13. In the case of a surrogate mare, the mare must be returned to Kattenheye at the expense of the buyer after weaning. Transport of Kattenheye's surrogate mare back to her owner is at the seller's expense. An additional cost of € 3000 excluding VAT is charged for the surrogate mare's deposit. This amount is paid by the buyer to the seller. When the surrogate mare is delivered to Kattenheye in good condition, this amount will be refunded to the buyer. It's also possible to buy the surragote mare for an amount of € 4000 excluding VAT.
  14. No rights are derived from the semen sold at this auction. That is to say, Kattenheye does not offer any pregnancy guarantee on the semen that is offered.
  15. The information concerning the foals, embryos, broodmares, .. is only intended to give an impression of the qualities of the foals, embryos, broodmares, .., without pretending to be complete and without giving any guarantees. Kattenheye is not liable for any printing errors and / or material errors on its website and online catalog.
  16. In case of export of the foal, the buyer will present a valid export document within 3 months after collection of the foal at Kattenheye, under penalty of still charging the VAT due.
  17. Belgian law applies to the relationship between Seller and Buyer.
  18. Any dispute arising from this auction and its consequences will be governed exclusively by Belgian law, excluding the provisions of the Vienna Sales Convention on international sales and sales. The Commercial Court of Ghent, Dendermonde Division and the Court of First Instance of East Flanders, Dendermonde Division, have exclusive jurisdiction to hear any disputes.
  19. In case of dispute, only the Dutch text applies. The translation of these auction conditions into a language other than Dutch is purely informative.
